These Terms & Conditions (“Terms”, “Terms of Service”) govern your use of lucyluart.com, operated by Lucy Lu Art (“we”, “us”, or “our”). Lucy Lu Art is registered in Australia (ABN 12 383 995 747).
By accessing or using this website and its services, you agree to comply with and be bound by these Terms and any other applicable policies or legal notices.

1. General Terms
By using our website, you confirm that you are at least the age of majority in your state or province of residence or have consent from your legal guardian. You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
Violating these terms may result in the termination of your access to our services.
You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

2. Product Information
While we aim to accurately display the colours and images of our products, we cannot guarantee that your computer monitor's display of colour will be accurate. Prices for products are subject to change without notice. We reserve the right to discontinue or modify any products or services at our discretion, and any offer is void where prohibited.
Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.
We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

3. Orders and Payments
You agree to provide accurate and complete information when making a purchase. We reserve the right to limit or cancel orders at our discretion, including those placed by dealers, resellers, or distributors. If we change or cancel an order, we will attempt to notify you via email or phone.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer.

4. Returns and Exchanges
No refunds or returns for change of mind. If your product is damaged upon arrival, you may request a refund or exchange within 30 days of purchase by emailing lucyluartworks@gmail.com.
To complete your return, we require a receipt or proof of purchase.
The item needs to be returned in the condition it was received, please email us before returning the item.
The customer must cover the return shipping costs.
Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.
If you are shipping an item over $75, you should consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.
Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.

5. Shipping Insurance & Responsibility
All original artworks are shipped with insurance through Australia Post or a courier service. In the rare event that an artwork is damaged during transit, I will assist in filing an insurance claim with the shipping provider.

6. Customer Actions & Reporting Damage
Customers must report any damage within 5 of receiving the artwork, providing clear photos of the damage and packaging.

7. Refund or Replacement Policy
If the insurance claim is approved and I receive reimbursement from the shipping provider, I will issue a full refund or offer a replacement of similar value. For commissioned artworks, I may offer to repaint the artwork. However, due to the nature of original art, the new piece may differ slightly from the original. If the claim is denied or significantly delayed, I will work with the customer to find a reasonable solution, but I cannot guarantee an automatic refund.
If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.
Late or missing refunds
If you haven’t received a refund yet, first check your bank account again.
Then contact your credit card company, it may take some time before your refund is officially posted.
Next contact your bank. There is often some processing time before a refund is posted.

To the fullest extent permitted by law, Lucy Lu Art's liability for any loss or damage, whether direct, indirect, incidental, special, or consequential, arising out of or in connection with the use of our website or the purchase of products, is limited to the total amount paid by the customer for the product(s) in question.
We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, loss of revenue, or loss of data, even if we have been advised of the possibility of such damages.

You agree to indemnify and hold us harmless from any claims, damages, or liabilities arising from your use of our website and services or violation of these Terms. The customer is responsible for any legal costs we incur as a result of their breach of the Terms.
